LivingWorks Connect - ACCEPTABLE USE POLICY

DISCLAIMER

All policies contained herein were adopted by LivingWorks and supersede previous policies. We periodically review policies in part or as a whole, to ensure that they continue to reflect current business practice and legislative requirements.

LivingWorks reserves the right to modify this policy, amend or terminate any policies or procedures, whether or not described in this document at any time.

This Acceptable Use Policy (“AUP”) is incorporated by reference into LivingWorks Education Inc. (“LivingWorks Connect,” “We,” “Us,” or “Our”) Terms of Use and governs your use of the App, Site and Services. BY CONSENTING TO THIS ACCEPTABLE USE POLICY, YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE READ THIS AUP, UNDERSTAND ITS TERMS, AND AGREE TO COMPLY WITH ITS TERMS. IF YOU DO NOT AGREE WITH THIS AUP, YOU ARE NOT PERMITTED TO USE OR ACCESS THE APP, SITE AND/OR SERVICES IN ANY WAY.

By using LivingWorks Connect, you agree to the Acceptable Use Policy. Unless you have read and agree to the Acceptable Use Policy, do not use LivingWorks Connect. If you do not agree to the Acceptable Use Policy, do not use LivingWorks Connect.

DEFINITIONS

CareGuide – a foundational feature of Connect, it is a guide and tool to support a helper through an intervention, providing guidance based on the training the helper has received, and enabling the helper to record and manage intervention information.

Communities – a foundational feature of Connect, it is a platform where organizations, trainers, and helpers can create local communities based on a variety of affiliations, such as geography, demographics, etc.

Connections – links between individual users based on mutual agreement which enable features such as chat or sharing resources between the connected users.

Intellectual property – creations such as inventions, literary and artistic works, software, designs, symbols, names, images and logos used in commerce.

LivingWorks Connect – digital platform that engages and empowers learners, trainers, and organizations to impact communities by helping make them safer from suicide.

Moderator – the individual(s) responsible for monitoring a communities’ discussions and content to ensure contributors and content are following community rules.

Personal Information – any information related to an individual that may reveal their identity.

Resources – a foundational feature of Connect which allows for sharing of resources in the context of suicide prevention and mental health support for suicide interventions or self-care.

Terms of Use – agreement which governs your access and use of our online platform and mobile application through which suicide intervention resources and assistance may be provided (collectively “LivingWorks Connect”) to which this AUP is subject.

WHO WE ARE 

The LivingWorks Connect platform is owned and operated by LivingWorks Education Inc. located at Suite 500, 151 Canada Olympic Road SW, Calgary, Alberta, Canada T3B 6B7.

OUR OBJECTIVE

The objective of the LivingWorks Connect platform is to provide a safe secure platform that engages and empowers learners, trainers, and organizations to impact communities by helping make them safer from suicide.

OUR EXPECTATIONS

To achieve our objective, LivingWorks has established the following expectations for all members:

  • We reserve the right to monitor and examine any activity performed on the platform. 
  • We reserve the right to remove content at our discretion and take action against any repeat offenders.
  • Access to the platform is restricted to parties who have acknowledged this Acceptable Use Policy and Terms of Use agreement.    
  • Users of the platform are considered trusted custodians with a responsibility and obligation to ensure:
    • The platform is protected from unauthorized access and misuse. 
    • Respect for individual’s privacy and the sensitive nature of their personal information. 
    • Consideration for the impact our actions can have on others. 
    • Only the data that is necessary for the purpose is collected. Never collect data that is not needed. 
    • Data is disclosed only to those with a need to know or see the data, and only after proper consent has been obtained and documented from the data subject. 
    • Data is handled and stored securely. 
    • Data is deleted when it is no longer needed.
  • Users must report any suspicious activity or policy violations in a timely manner to privacy@livingworks.net.

USE OF THESE SERVICES

When you consent to this Acceptable Use Policy you warrant that you understand and will comply with this Policy and all applicable laws and regulations.

GENERAL

You acknowledge that you will:

  • Treat everyone with respect and dignity, always.
  • Act responsibly and consider the impact your actions can have on others.
  • Respect individual’s privacy and the sensitive nature of their personal information and interactions.
  • Respect the copyright protections of intellectual property contributed to or used on the platform.
  • Act in accordance with the golden rule of privacy: “Do unto other’s personal information as you would expect others to do unto your personal information.”
  • Only use the application for its intended purpose – to help make communities safer from suicide.
  • Keep all information confidential.
  • Collect only information that is needed.
  • Store information only in the application in predefined fields.
  • Protect all information from misuse and unauthorized access or disclosure.
  • Only share information after proper consent from the data subject has been obtained and documented.

 

You acknowledge that you will not:

  • Make any unauthorized use of the Services, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.
  • Attempt to impersonate another user or person or use the username of another user.
  • Use any information obtained from the Services to harass, abuse, or harm another person.
  • Use the Services as part of any effort to compete with us or otherwise use the Services and/or the Content for any revenue-generating endeavor or commercial enterprise.
  • Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Services, except as expressly permitted by applicable law.
  • Attempt to bypass any measures of the Services designed to prevent or restrict access to the Services, Data or any portion of the Services.
  • Systematically retrieve data or other content from the Services to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
  • Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use of the Services or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Services.
  • Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats (‘gifs’), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as ‘spyware’ or ‘passive collection mechanisms’ (‘pcms’)).
  • Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Services.
  • Use the Services in a manner inconsistent with any applicable laws or regulations.
  • Sell or otherwise transfer your profile.
  • Infringe the intellectual property rights, privacy or other rights of any third person.
  • Be abusive, intimidating or to otherwise infringe or violate the rights of any person or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety.
  • Impersonate any person or misrepresent your identity or affiliation with any person.
  • Encourage other users to engage in self-harm or suicide-related behaviors.

COMMUNITIES

As a member of one or more communities, you acknowledge that you will:

  • Comply with the rules and guidelines established by the community.
  • Only submit content that is relevant to the community.
  • Respect the copyright protection and other proprietary rights of any content you may contribute to the community.
  • Not post or reference any material which may be considered defamatory, libellous, offensive, obscene, objectionable, harmful, fraudulent or illegal. Not post or reference any material that encourages other users to engage in self-harm or suicide-related behaviours in any situation or context.

ADDITIONAL RESPONSIBILITIES FOR COMMUNITY OWNERS AND ADMINISTRATORS

Community owners and administrators are responsible for content and activities performed within the community, including community posts, community resources, and community membership.

You acknowledge that:

  • By creating a community, you have accepted ownership for the community and all responsibilities associated with community ownership.
  • By accepting an administrator role in a community, you have accepted all responsibilities associated with community administration.
  • As an owner or administrator, you are responsible for:
    • Membership
      • The activities within the community of all members.
      • Reporting members who engage in behaviour within the community that violates the Connect Acceptable Use Policy.
      • Removing members who engage in behaviour that violates the Connect Acceptable Use Policy from the community.
      • Responding to requests to join the community in a timely manner.
    • Resources
      • Ensuring that all community resources are added solely for the purpose of helping to keep communities safer from suicide and that the content of the resource aligns to this goal.
      • Ensuring that community resources are current and valid.
      • Reviewing each community resource that has been flagged for suspected or alleged violation of the Connect Acceptable Use Policy in a timely manner, and removing the community resource if there are reasonable grounds to support the claimed violation of the Connect Acceptable Use Policy.
      • Ensuring that the community resources are relevant to the community.
    • Posts
      • Reviewing each post that has been flagged for suspected or alleged violation of the Connect Acceptable Use Policy in a timely manner, and removing the post if there are reasonable grounds to support the claimed violation of the Connect Acceptable Use Policy.

RESOURCES

All resources on the Connect platform must contribute to keeping communities safe from suicide. Connect resources may provide support for helpers, support for seekers, or general suicide prevention information.

Connect resources include:

  • contact information to individuals, groups or organizations;
  • links to a resources or set of resources;
  • media including video, audio or images;
  • documents such as guidelines, help information, or research

and may be added by owners or administrators to communities, or by any Connect user as a personal support. Community resources may be accessed by any Connect user, based on resource public or private (to the community) classification and the user’s community memberships. Access to personal resources is limited to the user and anyone else that the user has directly shared the resource with.

As a contributor to Connect resources, or a consumer of Connect resources, you acknowledge that:

  • All resources that you add to Connect are intended to contribute to keeping communities safe from suicide.
  • You will not add any resource that directly or indirectly encourages, promotes, or intentionally enables others to engage in self-harm or suicide-related behaviours in any situation or context.
  • You are not violating copyright or 3rd party acceptable use or terms of service by adding a resource to Connect.
  • You will share resources only for the purpose of helping to keep communities safer from suicide.

 

USE OF CAREGUIDE

It is important to understand that each suicide intervention is unique, and each intervention will have its own situation and context. What may be possible and appropriate in one situation, may not be in the next. This means that you will need to carefully and thoughtfully consider when and how to use CareGuide, to ensure that it is supporting the intervention and not distracting from, or interfering in, the intervention.

When participating in an intervention with a person that has thoughts of suicide, the interpersonal helping relationship is the top priority and necessary for the intervention. This means that, especially in the initial steps of an intervention, the helper must be focused on the seeker and listening carefully and responsively to build trust by giving them their undivided attention.

The specific situation and interactions between the helper and the seeker will determine when and how CareGuide can best be used to support the intervention and record a SafePlan, safety contacts, and/or follow up activities. There is no single rule that can be applied for the use of CareGuide – but generally CareGuide would only be used after the helper and seeker have agreed to work on next steps to keep safe from Suicide.

By consenting to the Connect Acceptable Use Policy, you acknowledge that:

  • There is absolutely no obligation to use CareGuide to support an intervention. The use of CareGuide, the extent of your use of CareGuide, how much intervention information is stored in CareGuide, and the timing of CareGuide use is completely up to you based on your best judgement and what you feel comfortable with.
  • To the best of your ability, you will use CareGuide thoughtfully and carefully to ensure that it supports the intervention and that the care for the seeker remains your focus.
  • The opportunity to record follow-up tasks or activities in CareGuide in no way obligates you to do so, or to have continuing interactions or relationship with the seeker. This will entirely depend on the situation and the nature of the helper’s relationship with the seeker and is at the discretion of the helper.
  • Your reflections and observations recorded in CareGuide should be your personal reflections and situational observations to support the intervention and/or for your future reference to support ongoing interactions with the seeker (in situations where there are follow-up interactions) and your effectiveness as a helper. The recording of clinical case notes or diagnosis notes should be left to qualified professionals, whether using CareGuide or any other medium.
  • All interventions are unique and the situation for each intervention will determine when and to what extent CareGuide should be used.
  • When recording intervention information, all information is recorded for the sole purpose of helping the seeker in this intervention and improving your effectiveness as a helper to better help other potential seekers in future interventions.
  • When obtaining consent for recording intervention information such as connections to help, follow-up activities, or SafePlan, you have communicated what you are recording to the seeker as clearly as you are able to and obtained consent as best possible in the given situation from the seeker.
  • If you have recorded intervention information, you will endeavour to make the information available to the seeker and inform them that they are free to have the information removed from Connect at any point.

CONTENT IN VIOLATION OF THE CONNECT ACCEPTABLE USE POLICY

You agree to help ensure that the Connect platform and services are used to help make our communities safer from suicide by using the means provided within the application, where provided, to flag the following when you believe that it may not comply with the letter or spirit of this Acceptable Use Policy and/or the Terms of Use:

  • Communities
  • Community Posts
  • Resources (Community or other)

 

As a second option, users may report any policy violation or suspicious activity to connect.admin@livingworks.net

VIOLATIONS OF THIS POLICY

Violations of this Acceptable Use policy make the Service less trustworthy, safe and hospitable. If someone violates our policy, we may limit their ability to use the platform or terminate the account.

If someone violates applicable laws and regulations, then we might take legal action which may result in civil and criminal penalties.
